§ 16-146. Policy of responsibility.

The city manager or his designee shall develop administrative policies in order to regulate litter on building sites or subdivision developments sites, pursuant to the following:

(1)

It shall be unlawful for a responsible party to allow litter to be carried or deposited upon any public place or other private premises from a construction site.

(2)

It shall be unlawful for a responsible party to allow litter to be deposited on or accumulate on any construction site. The fact that litter is found on any construction site shall be prima facie evidence of a violation of this division. The responsible party shall maintain an adequate number of trash receptacles at each construction site for the purpose of onsite disposal of litter. The responsible party shall provide for the adequate disposal of litter and trash from the receptacles by appropriate means.
