§ 26-217. Definitions.

  • The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Adult means any individual 18 years of age or older.

    Business district means the territory adjacent to and including a highway if the buildings used for business or industrial purposes, including a building used as a hotel, bank, office building, public building, or railroad station:

    (1)

    Are located within a 600-foot segment along the highway; and

    (2)

    Within that segment the buildings must occupy at least 300 feet of frontage:

    a.

    On one side of the highway; or

    b.

    Collectively on both sides of the highway.

    Child means any individual under 18 years of age.

    Coaster or scooter means a nonmotorized footboard mounted upon two or more wheels, controlled by an upright steering handle, and is most often propelled by the user usually in an upright position or kneeling.

    Helmet means properly fitted protective headgear that is not structurally damaged and that conforms to the standards of the American National Standards Institute, the American Society for Testing and Materials, the Snell Memorial Foundation or any federal agency having regulatory jurisdiction over bicycle helmets, as applicable, at the time of the manufacture of the helmet.

    Inline skates means a pair of shoes or boots, mounted upon three or more sets of wheels located one behind the other under the attached shoe or boot, and is most often propelled by the user in an upright, standing position.

    Parent means the natural or adoptive parent or court-appointed guardian or conservator of a child.

    Public highway means the entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.

    Public way or public property means real property owned, leased or controlled by a political subdivision of the state, a governmental entity or agency, or similar entity, or any property that is publicly owned or maintained or dedicated to public use including, but not limited to, a path, trail, sidewalk, alley, street or highway, and a public park facility.

    Rollerskates has its ordinary meaning and means a pair of shoes mounted upon two sets of wheels, most often propelled by the user in an upright, standing position.

    Sidewalk means that property between the curblines or the lateral lines of a roadway and the adjacent property, set aside and intended for the use of pedestrians or such portion of private property parallel and in proximity to a public highway and dedicated to use by pedestrians.

    Skateboard includes a board constructed of any material with wheels affixed to the underside, designed to be ridden by a person.

    Wearing a helmet means that the person has a helmet fastened securely to his head with the straps of the helmet securely tightened in the manner intended by the manufacturer to provide maximum protection.
