Chapter 42. TELECOMMUNICATIONS |
Article II. SERVICE PROVIDERS AND FACILITIES OF PUBLIC RIGHTS-OF-WAY |
Division 1. GENERALLY |
§ 42-20. Purpose of article.
(a)
Purpose. The purpose of this article is to:
(1)
Assist the management of the public rights-of-way in order to minimize the congestion, inconvenience, visual impact and other adverse effects, and the costs to the citizens resulting from the placement of telecommunications facilities in public rights-of-way;
(2)
Govern the provider's use and occupancy of the public rights-of-way;
(3)
Compensate the city for the private, commercial use and occupancy of the public rights-of-way by the telecommunications providers in a nondiscriminatory and competitively neutral manner;
(4)
Assist the city in its efforts to protect the public health, safety and welfare;
(5)
Facilitate competition among the telecommunications service providers and encourage the universal availability of advanced telecommunications services to all residents and business of the city;
(6)
Conserve the limited physical capacity of the public rights-of-way held in public trust by the city.
(b)
Title. This chapter may be referred to as the "Telecommunications Ordinance."
